February 23, 2010
Members present: Seeboth, Berg, Dove, Lochner, and Potter, along with Lay Board Members Kuster and Mohr. Also in attendance were Administrator Enter, Assistant County Attorney Berg, and Family Services Director Henderson.
M/Potter, S/Lochner, to accept the Minutes of 2-16-10 and authorize publication of the Synopsis of same, carried.
M/Berg, S/Lochner, to schedule a Closed Session for labor negotiation strategy planning to be held in the Commissioners Room 204 of the Brown County Courthouse, New Ulm, MN at approximately 11:30 AM this date 2-23-10 for the Law Enforcement Labor Services, Inc. (LELS) Locals #94 and #98 and for the two (2) AFSCME Collective Bargaining Units (Courthouse and Highway) pursuant to MS 13D.03, carried.
M/Lochner, S/Dove, to accept and file the annual Consolidated Chemical Dependency Treatment Fund Report, carried.
M/Berg, S/Potter, to accept and file the Mid-Year Energy Assistance Program Report, carried.
M/Potter, S/Dove, to accept and file the update on the Family Facilitator Program in Brown County that originated under the Three Counties for Kids Collaborative in 1994, carried.
M/Lochner, S/Berg, to accept and file the 2009 Summary Budget Report for Income Maintenance & Social Services for the Brown County Family Services Dept.; 2009 Collaboratives Summary Budget Report; Targeted Case Management Earnings Report comparing 2007, 2008 and 2009; and Waiver/TCM earnings 2008/2009, carried.
M/Potter, S/Seeboth, to authorize payment of Family Services Administrative claims in the amount of $1,157.51, carried.
M/Potter, S/Berg, to accept Family Services Correspondence Item #1 and Consent Agenda Items #1 thru #9, carried.
M/Lochner, S/Potter, to accept and file the Social Service Case Actions Listing for the period 1-1-10 thru 1-31-10, carried.
M/Berg, S/Potter, to accept the State of MN Dept. of Veterans Affairs County Veterans Service Office Enhancement Grant Program Grant Contract CFMS #B38989 in the amount of $3,780 to conduct Veterans Outreach at the 2010 and 2011 Farmfest Show at Gilfillan Estate in Redwood County and authorize Board Chairman Seeboth and Brown County VSO Peterson to sign same on behalf of Brown County, carried.
M/Lochner, S/Dove, to approve Res. No. 2010-08 authorizing Brown County to enter into a Grant Contract with the MN Dept. of Veterans Affairs to conduct a FY 10 CVSO Veterans Service Enhancement Project, carried.
M/Lochner, S/Potter, to accept and file the January 2010 Monthly Reports of Activity for the Brown County Sheriff's Dept., carried.
M/Berg, S/Dove, to approve the State of MN Grant Contract CWF-10 (#B39747) to accept funds in the amount of $33,065 for the Surface Water Assessment Grant (SWAG) project to monitor four streams/ditches (reaches) in Brown County over two years and authorize Board Chairman Seeboth to sign same on behalf of Brown County, carried.
M/Potter, S/Lochner, to approve the Contract with Independent Caretaker Maintenance Agreement with David Helget to serve as Park Caretaker for the 2010 park season (4-15-10 thru 10-15-10) for Treml County Park in the amount of $4,000; and to approve the Contract with Independent Caretaker Maintenance Agreement with Randy Berg to serve as Park Caretaker for the 2010 park season (4-15-10 thru 10-15-10) for Lost Dog & Fox Hunters County Park in the amount of $3,402; and to approve the Contract with Independent Caretaker Maintenance Agreement with Gary Schenk to serve as Park Caretaker for the 2010 park season (4-15-10 thru 10-15-10) for Mound Creek County Park including winter monitoring (10-15-10 thru 4-15-11) for a total contract cost in the amount of $10,380, carried. It should be noted that both the Lost Dog & Fox Hunters County Park contract and the Treml County Park contract include language and payment ($20/day) for days each park is open beyond the normal park season of April 15 to October 15.
At 11:00 AM, Chairman Seeboth convened a Public Hearing on proposed dissolution of the Brown County HRA pursuant to MN Statute 469.033, Subd. 7. There being no public testimony, a Resolution approving dissolution of the Brown County Housing and Redevelopment Authority (HRA) was presented as follows:

RESOLUTION APPROVING THE DISSOLUTION OF THE
BROWN COUNTY HOUSING AND REDEVELOPMENT AUTHORITY
The following Resolution was offered by Commissioner Potter and moved for adoption at a Regular Meeting held on February 23, 2010, at the Brown County Courthouse, New Ulm, MN:
BE IT RESOLVED by the Board of Commissioners of Brown County (the "County") as follows:
Section 1. Recitals. There has been established the Brown County Housing and Redevelopment Authority (the "HRA") and the HRA has been authorized by the County pursuant to Minnesota Statutes, Section 469.004 to transact business and exercise its power in the County. The HRA is currently inactive and does not have any outstanding contractual or other obligations, and it has been proposed that the County dissolve the HRA pursuant to Minnesota Statutes, Section 469.033, subdivision 7. The Board of Commissioners of the HRA have adopted a resolution approving the dissolution of the HRA and requesting that the County approve the dissolution of the HRA. This Board has held a public hearing on dissolution of the HRA after 10 days published notice thereof.
Section 2. Dissolution of HRA. The dissolution of the HRA is hereby approved and the County Administrator is hereby authorized to furnish to the Minnesota Commissioner of Employment and Economic Development a certified copy of this resolution.
Section 3. Effective Date. This resolution shall be in full force and effect upon its passage.
Seconded by Commissioner Berg and the same being put to a vote was duly carried.
This Resolution shall become effective immediately and without publication.
Adopted by the following vote: Ayes 5 Nayes 0.

M/Lochner, S/Dove, to authorize the transfer of the final HRA Fund 25 cash balance to the Brown County Capital Improvement Fund 37, carried.
M/Lochner, S/Dove, to request a revised cross-county ditch billing with documentation from Redwood County for cross county drainage ditch expenses in 2009 to be requested by letter through the Brown County Attorney's Office with coordination of A/T Helget, carried.
C-1 thru C-15 were accepted and filed.
Berg reported on the recent SCHSAC meeting; Lochner reported on SCHA, a Wetlands meeting, and on the State Bonding Bill; Dove reported on Sioux Trails; Potter reported with Dove on the Economic Development meeting on 2-17-10, and on RCRCA and the SWCD meeting on 12-22-10.
M/Lochner, S/Potter, to approve the appointment of Jessica Scherr as a FT IT/Office Support Specialist for the Family Services Dept. at the annual salary of $30,273 (Grade IX, Step 1) contingent on passage of the pre-placement physical and with a projected start date of 3-8-10, carried.
At 11:33 AM, Chairman Seeboth convened a Closed Session for Labor Negotiation Strategy Planning, pursuant to M.S.13D.03, for the LELS, Inc. Locals #94 and #98 Sheriff's Dept. Collective Bargaining Units; and for the two (2) AFSCME Collective Bargaining Units (Courthouse and Highway). This session was attended by Commissioners Seeboth, Berg, Dove, Lochner, and Potter along with County Administrator Enter, Assistant County Attorney Berg, Sheriff Hoffmann, Personnel Director Crabtree, and Attorney Frank Madden via telephone at 11:34 AM. The Closed Session adjourned at 11:55 AM.
Calendars were coordinated for the next two week period.
There being no further business, Chairman Seeboth adjourned the Meeting at 11:59 AM.
