M/Potter, S/Dove, to approve the Letter of Agreement between the New Ulm Medical Center and Brown County Family Services (BCFS) to provide preplacement team consultation at a cost of $90 per hour for the period of 11-1-09 thru 12-31-10, carried.
M/Berg, S/Lochner, to approve the Agreement between BCFS and Brown County Public Health for long term care consultation services for individuals 65 years of age and older at a cost of $120 per hour for the period of 10-1-09 thru 9-30-11, carried.
M/Lochner, S/Potter, to approve the Home and Community-Based Waiver Services Contract for Connections Homes administered by Greater Minnesota Family Services for a daily rate of $268.37 and a monthly rate of $8,162.90 for the period of 10-1-09 thru 9-30-10, carried.
M/Berg, S/Potter, to approve the Agreement, as revised, with Minnesota Valley Action Council to provide Food Support Employment and Training Program services from 10-1-09 thru 9-30-10 at a cost of $3,199 to provide employment counseling services to Food Support recipients who are not exempt from having to work, carried.
M/Potter, S/Dove, to authorize the payment of Family Services Administrative Claims in the amount of $3,791.07, carried.

M/Berg, S/Potter, to table consideration the Sanitary Landfill Operation Contract with Mathiowetz Enterprises, Inc. for the period of 4-1-10 to 3-31-13, and refer back to the Brown County Solid Waste Advisory Committee for further study, motion to table carried 4-1, with Seeboth dissenting.
M/Potter, S/Berg, to accept the quote dated 10-15-09 from Sid Sign's in the amount of $1,586.03 for the purchase of twelve (12) replacement signs for all county parks that will address changes in the Park Ordinance, carried 5-0. An additional quote dated 10-19-09 was received from Printware Graphics.
M/Berg, S/Dove, to authorize the purchase of a John Deere X340 with a 54" deck in the state contract amount of $4,863.95 less trade-in $1,200 (1999 John Deere tractor with a 38" deck), plus sales tax $270.22, for a total amount of $3,934.17, carried 5-0. Additional state contract quotes were received as follows: John Deere X324 with a 48" deck (4 wheel steering); John Deere X320 with a 48" deck; and Kubota with a 48" deck.
M/Berg, S/Lochner, to authorize the purchase of a Case/IH tractor with front wheel assist in the state contract amount of $23,850.00 plus sales tax of $1,639.69, for a total amount of $25,489.69, carried 5-0. An additional state contract bid was received for a John Deere 5065 (without front wheel assist).
M/Potter, S/Lochner, to accept and file the Highway Dept. Monthly Update as follows: 2009 Construction Projects Update; Maintenance Projects Update, carried.
M/Lochner, S/Potter, to grant a leave of absence for Barb Buboltz, Intermittent PT Bailiff, for the time period of 11-2-09 thru 4-4-10, carried.
M/Potter, S/Dove, to approve regular employee status for Karen Moritz, FT Public Health Director; Melissa Horning, FT MCH Public Health Nurse; and Christine Pfarr, Regular PT Adult Health RN, carried.
M/Berg, S/Dove, to approve the appointment of Sue Wieland and Jason Melby to the FT Dispatcher position at the annual salary of $41,631 (Grade XI, Step 9) and $37,684 (Grade XI, Step 3) respectively, with projected start of 11-13-09; and authorize posting the vacated Correctional Officer Sergeant position according to contract, carried.

M/Dove, S/Berg, to grant a leave of absence to Kathleen Helget, Regular PT Bus Driver, for a time period of 10-5-09 thru 12-5-09, carried.
M/Potter, S/Dove, to approve a letter of intent to accept the Division of Emergency Communication Network's offer to fund the acquisition and installation of two (2) ARMER radio control stations for the Public Safety Answering Point and one radio control station for the Emergency Operation Center in Brown County, carried.
M/Lochner, S/Berg, to authorize the use of drug forfeiture funds designated for the County Attorney's Office to be used for the purchase of an Intel Core computer to include a 20" flat panel monitor, software and warranty in the estimated amount of $1,373.31 (includes sales tax) for the new Assistant County Attorney, carried 5-0.
M/Dove, S/Lochner, to re-affirm an appropriation in the amount of $5,292 as 2010 supplemental funding for the BNW Adult Drug Court operations expenses, subject to final 2010 county budget approval, carried.
At 11:10 AM, Chairman Seeboth recessed the Regular Meeting and convened a Public Hearing to consider the adoption of a Brown County Ordinance for Regulating Parking on County-Owned Property. Affidavits of publication of the legal ad for the public hearing were noted to be on file. There was no public testimony received. M/Lochner, S/Potter, to approve Brown County Ordinance No. 2009-02 for Regulation of Parking on County-Owned Property as follows: ORDINANCE NO. 2009-02, County of Brown, State of Minnesota, AN ORDINANCE FOR REGULATION OF PARKING ON COUNTYOWNED PROPERTY
The Brown County Board of Commissioners ORDAIN:
Section 1. The Brown County Board of Commissioners, pursuant to the authority provided in MSA 373.26, may, by resolution, designate certain areas where the right to park is limited during hours specified. The Facilities Manager shall mark by appropriate signs each zone so designated. During the hours specified on the sign, no person shall park a vehicle in any limited parking zone for a longer period than is specified.
Section 2. The Brown County Board of Commissioners, may, by resolution, designate certain areas where the right to park shall be limited to either County Employees or persons who are not County Employees. The Facilities Manager shall mark by appropriate signs each zone so designated. No person shall park a vehicle in any limited parking zone in violation of such appropriate sign.
Section 3. The Sheriff shall enforce the provisions of this ordinance.
Section 4. The Sheriff may remove a vehicle which is in violation of the provisions of the ordinance. Such vehicle shall not be released until the fees for towing and storage are paid in addition to any fine imposed for violation of this ordinance.
Section 5. The presence of any motor vehicle on any lot when standing or parked in violation of this ordinance is prima facie evidence that the registered owner of the vehicle committed or authorized the commission of the violation.
Section 6. Any person convicted of violating any provision of this ordinance is guilty of a petty misdemeanor and shall be punished by a fine not to exceed three hundred dollars ($300.00).
Section 7. This ordinance shall be effective upon passage and publication in accordance

The motion to adopt the ordinance carried on a roll-call vote of 5-0.
M/Lochner, S/Dove, to approve the following Board Meeting dates for 2010: 1st, 3rd & 4th Tuesdays of January through November; and the 1st Wednesday, 2nd & 4th Tuesdays of December, carried.
Correspondence C-1 thru C-9 were accepted and filed. Seeboth reported on a Center for Rural Affairs correspondence; Lochner reported on SCHA matters.
Calendars were coordinated for the next two week period. By consensus, the County Board agreed that Berg will serve as voting delegate at the MCIT Annual Meeting on 12-7-09 Dove will serve as alternate.
At the conclusion of the meeting, Chairman Seeboth expressed special thanks to retiring County Attorney James R. Olson for his dedicated service to the citizens of Brown County, having served as Brown County Attorney since May 1, 1985, for twenty-four and a half years, and having served as counsel to the Brown County Board of Commissioners and attending over eight hundred (800) County Board of Commissioners meetings during his public service as Brown County Attorney. The County Commissioners congratulated Brown County Attorney Olson and wished him well in his retirement.
There being no further business, Chairman Seeboth adjourned the Meeting at 11:35 AM.
