SYNOPSIS OF COUNTY BOARD MEETING

Members present: Seeboth, Berg, Dove, Lochner, and Potter along with County Administrator Enter and Assistant County Attorney Hinnenthal.

M/Lochner, S/Potter, to accept the Minutes of 8-25-09 and authorize publication of the Synopsis of same, carried.

M/Lochner, S/Dove, to table consideration of the claim in the amount of $1,950 trial & investigation expense in the Sheriff's Dept. related to the Hauser Case until the 9-15-09 Board Meeting pending further information, carried.

M/Berg, S/Dove, to authorize the payment of General Government claims as revised in the amount of $125,494.20, carried.

M/Lochner, S/Dove, to approve Res. No. 2009-19 authorizing final acceptance and final payment to DM&E Railroad Corporation for the Project SAP 08-627-22 (railroad crossing signal upgrade project on CSAH 27), carried.

M/Potter, S/Lochner, to approve Res. No. 2009-20 approving final acceptance for SP 08-070-001, SP 08-070-002 & SP 08-070-003 Edge Line Rumble Stripes Projects on CSAH 13, CSAH 27 & CSAH 29, carried, with Dove dissenting.

M/Berg, S/Potter, to accept the retirement of Willard Kirckof, Regular PT Bus Driver for Brown County Heartland Express on 11-5-09 and refer to the current eligibility list being developed to fill this vacancy in November, carried.

M/Potter, S/Lochner, to authorize Potter, Brown County's Rep. to RCRCA, to sign Addendum No. 2 to the RCRCA Joint Powers Agreement (JPA) on behalf of Brown County, which extends the effective period of said JPA to 6-30-11, this motion was set aside until later this date in order to review the termination clause in the RCRCA JPA.

M/Lochner, S/Berg, to authorize Area II MN River Basin Projects, Inc. Rep. Lochner to sign

Addendum No. 7 to the Area II MN River Basin Projects, Inc. JPA on behalf of Brown County, which extends the effective period of said JPA to 6-30-10 with all other terms and conditions of the JPA remaining unchanged, carried.

M/Lochner, S/Potter, to include an amount of $15,000 in the 2010 budget to maintain the Intensive Intervention Program (75% budgeted in Probation and 25% budgeted in Family Services),

subject to final budget approval, carried.

M/Potter, S/Lochner, to authorize Potter, Brown County's Rep. to RCRCA, to sign Addendum No. 2 to the RCRCA JPA on behalf of Brown County, which extends the effective period of said JPA to 6-30-11, motion failed, with Lochner, Dove, Berg, and Seeboth dissenting.

M/Lochner, S/Dove, to authorize Potter, Brown County's Rep. to RCRCA, to sign Addendum No. 2 to the RCRCA JPA on behalf of Brown County, which extends the effective period of said JPA to 6-30-10, carried.

Correspondence C-1 thru C-8 were accepted and filed.

The Commissioners toured the Courthouse upper level to view the HVAC system equipment and controls that have been in operation for over forty (40) years.

At 10:23 AM, TRANE representatives presented a Facility Infrastructure and Energy Efficiency Improvement Project which included proposals for energy conservation measures in the courthouse and several county buildings. The report also recommended the upgrade of the Courthouse heating/ventilation/air conditioning (HVAC) system which was installed in the late 1960's and includes TRANE equipment and controls. In the event that the County Board authorizes said project, TRANE would provide to Brown County a "Guaranteed energy-savings contract" as described in Minnesota Statutes 471.345 Subdivision 13. After

lengthy discussion, by consensus, the County Board accepted and ordered filed the report by

TRANE Representatives on a proposed Facility Infrastructure and Energy Efficiency Improvement Project, with the County Board considering a Letter of Commitment for said project at the 9-15-09 regular Board meeting. It was also noted that the Joint Law Enforcement Center which was built in 1993-94 utilizes TRANE HVAC control systems and that an upgrade of the Courthouse HVAC system could utilize the existing LEC computerized control system.

Calendars were coordinated for the next two week period.

There being no further business, Chairman Seeboth adjourned the Meeting at 12:05 PM.
