SYNOPSIS OF COUNTY BOARD MEETING

Members present: Seeboth, Berg, Dove, Lochner, and Potter along with County Administrator Enter and Assistant County Attorney Hinnenthal.

M/Lochner, S/Potter, to accept the Minutes of 6-23-09 and authorize publication of the Synopsis of same, carried.

M/Berg, S/Lochner, to authorize the payment of General Government claims as revised in the amount of $170,458.47, carried.

M/Potter, S/Lochner, to authorize four (4) Drainage Ditch Repair Requests, carried.

M/Lochner, S/Berg, to schedule a Hearing on the Petition of Leon Helget for Authorization to Establish an Outlet in Brown County Ditch #11 for 10:00 AM on 8-18-09 in Commissioner Room 204 of the Brown County Courthouse in New Ulm, MN, carried.

M/Lochner, S/Potter, to accept and file the Cash Management/Investment Report through 6-30-09 reflecting an invested balance of $14,359,031.99 with an average rate of 3.25% on the CD investments, carried.

The County Board revisited the 4-7-09 Annual County Audit discussion that was tabled which reviewed the possible request to the state to pursue annual audit services by a private certified public accountant. The Board noted the 2008 audit is nearly complete at this time; the county staff exit briefing was held on 6-15-09; and a letter dated 4-17-09 from the Deputy State Auditor indicated the intent of the State Auditor's Office to continue performance of the annual Brown County audit through the years ending 12-31-11. M/Potter, S/Lochner, to accept and file the report on options for performance of the annual county audit, carried.

M/Berg, S/Seeboth, to approve and authorize the Board Chairman, County Administrator, and County Auditor/Treasurer to sign the Letter of Compliance dated 7-9-09 to the Minnesota Office of the State Auditor regarding audit of the financial statements of Brown County ending 12-31-08 and the year then ending, carried.

M/Lochner, S/Dove, to approve the MN Dept. of Public Safety Alcohol and Gambling Enforcement Division Renewal Application for Optional 2:00 AM Liquor License by City Limits of Sleepy Eye, Inc, carried.

M/Potter, S/Dove, to approve a Brown County Proclamation designating July 19-25, 2009 as "Probation, Parole, and Community Supervision Week", carried.

M/Dove, S/Lochner, to approve an appropriation in the amount of $5,292 as 2010 supplemental funding for the Brown Nicollet Watonwan Adult Drug Court operations expenses, contingent on supplemental funding approval also by Nicollet and Watonwan Counties, and subject to final 2010 county budget approval, carried.

M/Berg, S/Potter, to approve the appointment of Commissioner Dove to serve as Brown County's representative on a committee that will address specific budget issues of the Brown, Lyon, and Redwood Counties Drug Task Force, with Commissioner Lochner serving as alternate, carried.

Correspondence C-1 thru C-13 were accepted and filed.

Lochner reported on Detention matters, Area II, and with Berg on CHS; Berg and Dove reported on the Finstad bridge matter on JD #10 B&BE; and Potter reported on the Park Commission meeting of 7-6-09 at Mound Creek County Park.

M/Lochner, S/Berg, to deny the request of Mr. & Mrs. Norman P. Fox to utilize Soldiers' Rest plots in the New Ulm Cemetery due to non-compliance with the residency requirements in the Rules and Regulations Governing Soldiers' Rest Cemeteries adopted by the Brown County Board of Commissioners on 12-22-08, carried. It was noted that Brown County's Rules and Regulations Governing Soldiers' Rest Cemeteries were adopted after a two year research and development process which included review and input on the draft rules by representatives of the veterans' organizations in the county.

M/Lochner, S/Dove, to approve the purchase of ZixCorp email encryption three (3) year service in the total amount of $22,680 ($7,560/year) plus applicable sales tax to ensure that all Individually Identifiable Health Information data on individuals will remain protected against access without proper authorization, carried, with Seeboth dissenting.

M/Berg, S/Potter, to approve the purchase of a WatchGuard firewall upgrade device for the internet service in the amount of $1,895 and software in the amount of $350 plus sales tax, carried.

M/Lochner, S/Berg, to approve the following School Health Nursing Services Agreements between Brown County Public Health and the following schools in the county for the 2009-10 school year: Comfrey School District #81: $6,657.00 - 4 hours per week; Sleepy Eye School District #84: $53,524.00 - 7 hours per day/5 days per week (including Sleepy Eye Public; St. Mary's School; and St. John's School); River Bend Education District: $2,617.00 - Up to 65 hours per year; New Ulm School District #88 for Non-Public Schools: $55,419 - 34-37 hours per week (including 8-9 hours per week at St. Paul's; 8-9 hours per week at MVL; and 18-19 hours per week at NUACS), carried.

M/Lochner, S/Dove, to approve the appointment of Commissioner Berg to the Brown County Statewide Health Improvement Program (SHIP) Partnership, with Commissioner Seeboth serving as alternate, carried.

M/Berg, S/Potter, to approve the .5 FTE position for a local Statewide Health Improvement Program Coordinator with the .5 FTE to be spread among existing Public Health Nursing part time staff and being effective as long as grant funding continues, carried.

M/Lochner, S/Potter, to approve the appointment of Laura Filzen to the FT Social Worker CP/CMH position at the annual salary of $44,590.00 (Grade XVI, Entry) and with a projected start date of 7-31-09, carried.

M/Berg, S/Lochner, to accept the retirement of Ann Wiltscheck, FT Social Worker CP/CMH on 10-30-09 and authorize posting the vacated position according to policy, carried.

M/Lochner, S/Potter, to approve the appointment of Desiree Hohenstein to the FT Assistant Zoning Administrator position at the annual salary of $40,880.00 (Grade XII, Step 4) with a projected start date of 7-7-09 and post the vacated position of Recycling/Wetland/Water Plan Coordinator according to policy/contract, carried.

M/Lochner, S/Potter, to approve Res. No. 2009-15 that establishes Brown County as the "Sponsor" to continue the low interest loan funding through the PCA for the Middle MN Watershed in Brown County, carried.

M/Berg, S/Potter, to authorize the use of the County Septic Loan fund as the in-kind match to the Middle Minnesota Septic Loan Program - Project Implementation Continuation Grant in Brown County in cooperation with the Minnesota Pollution Control Agency, carried.

M/Potter, S/Lochner, to accept the low quote received from Treat's Home Center in the amount of $2,398.74 for carpet replacement in two (2) Court Administrator Offices (Room 309 & 310) located on third floor of the Brown County Courthouse with funding provided in the 2009 Building Fund 14 budget, carried. Additional quotes were received from Retzlaff's Floors & More and from New Ulm Furniture Co.

M/Berg, S/Potter, to approve Res. 2009-16 for use of bridge bond funds for the SAP 08-611-18 bridge replacement project on CSAH 11 over the Cottonwood River using Federal, State Aid and Bridge Bond Funds, carried.

M/Potter, S/Berg, to authorize the Highway Engineer to order a new tandem snowplow International cab & chassis truck in the state contract bid amount of $89,700.00, less trade-in of Unit 110 (1999 Sterling Truck) $25,000.00 for a net amount of $64,700.00 and sales tax $4,448.13 for a total amount of $69,148.13; and to authorize the purchase of the box, plow and associated equipment for the new tandem snowplow truck from Towmaster in the state contract bid amount of $77,838.00 plus sales tax $5,351.36 for a total amount of $83,189.36, carried. Additional cab/chassis state bids were received from Freightliner and Mack. Additional box/plow/related equipment state bids were received from TBEI and from Crysteel.

M/Lochner, S/Potter, to set the bid letting date for the SAP 08-599-47 Bridge Replacement and Approach work on 300th Street over Spring Creek (JD 29) in Eden Township for 8-20-09 at 10:00 AM in the Commissioner Room 204 of the Brown County Courthouse, carried.

M/Potter, S/Berg, to set the bid letting date for the SAP 08-599-53 Bridge Replacement and Approach work on 150th Street over an unnamed stream in Stately Township for 8-20-09 at 10:00 AM in the Commissioner Room 204 of the Brown County Courthouse, carried.

M/Lochner, S/Potter, to accept and file the Highway Dept. Monthly Update as follows: 2009 Construction Projects Update; Maintenance Projects Update, carried.

M/Lochner, S/Potter, to approve the Minutes of the Board of Appeal & Equalization Meeting held on 6-16-09 which was continued to 6-22-09 as revised and authorize publication of same, carried.

Calendars were coordinated for the next two week period.

There being no further business, Chairman Seeboth adjourned the Meeting at 11:32 AM.
