Movie firm flies them home

NEW ULM - After nearly a week of fleeing court-ordered chemotherapy treatment for cancer, a 13-year-old Sleepy Eye boy and his mother returned to Minnesota early Monday.

Speaking at a press conference outside the Brown County Courthouse late Monday afternoon, Sheriff Rich Hoffmann said Orange County, California attorney Jennifer L. Keller contacted the sheriff's office on Sunday on behalf of Colleen Hauser and indicated she wanted to bring her son Daniel home.

Discussions with Keller, Hoffmann and the FBI led to the Hausers returning to New Ulm at 3 a.m. Monday by charter flight donated by Asgaard Media, a Las Vegas-based company that develops, finances, produces and distributes motion pictures.

The Hausers were taken home, and the boy was immediately checked over medically, according to a sheriff's office news release.

Brown County Attorney Jim Olson said Monday evening that he understood the Hausers requested a court hearing in Brown County District Court today.

Olson said he understood Daniel Hauser was in a Twin Cities hospital for diagnosis re-staging to determine if his cancer has spread and to determine what treatment modalities may be used.

Because Colleen Hauser returned voluntarily, Olson said he would likely dismiss the felony complaint against her. Minneapolis FBI spokesman E.K. Wilson said the federal charge of unauthorized flight would also likely be dropped.

Daniel Hauser was evaluated at a hospital in the Twin Cities on Monday and his parents were with him, according to Tom Hagen, an attorney at the law office representing Daniel's parents.

Daniel was expected to spend Monday night at the farm. A court order placed Daniel in protective custody last week, but Olson said Brown County Family Services was comfortable allowing Daniel to stay with his parents.

Olson said a deputy was posted at the Hauser farm Monday night ''just to make sure nothing bad happens.''

Olson doesn't anticipate additional charges at this point, but said he hadn't seen all the police reports and he'd have to wait and see what happens at a court hearing, which will likely happen today.

''A lot depends upon the attitude of the parents, their willingness to get on board with a treatment plan,'' said Olson. ''If they are going to continue with this, 'We don't want chemo,' ... We'll see what happens tomorrow.''

Hoffmann declined to elaborate on Keller's involvement.

There are currently no outstanding charges against the Hausers in Brown County, said Chief Deputy Jason Seidl later Monday evening.

Dr. Bruce Bostrom, the pediatric oncologist at Children's Hospitals and Clinics of Minnesota who diagnosed Daniel's cancer in January, said he was happy to hear of the boy's return.

''I'm delighted,'' Bostrom said. ''I've been so worried that he was going to die in Mexico. I've been praying for his safe return, so I think my prayers will be answered.''

Meanwhile, Hoffmann declined to comment on whether the Hausers visited any alternative cancer treatment clinics while out of state.

Brown County District Court was informed of the Hausers' voluntary return and quashed an arrest warrant issued by Judge John Rodenberg.

"It is my understanding that the federal fugitive warrant will also be dropped, which usually happens in these cases," Hoffmann said. "Daniel and Colleen have been reunited with their family in rural Sleepy Eye, pending future court proceedings. The Hauser family requests no media contact at this time."

Squad cars blocked the entrance to the Hauser farm Monday to ensure their privacy.

Hoffmann said the Brown County Sheriff's Office was no longer involved in the case.

He said he could not comment on any possible charges that may be filed against any persons related to the case.

"It's a good day as Daniel and Colleen Hauser have been safely returned to Minnesota," Hoffmann said. "I want to thank the media too. They really helped us get the word out."

In Brown County District Court testimony two weeks ago, doctors said a cancerous tumor in Daniel Hauser's chest would likely kill him without chemotherapy.

Daniel completed one round of a recommend six rounds of chemotherapy in early February.

The tumor then shrank, but it has since returned to its original size, according to court documents.

Colleen and Daniel Hauser flew from Minneapolis to Los Angeles last Monday. Colleen informed her husband that she was leaving, saying that's all he needed to know.

The Hausers were believed to be seeking cancer treatment in northern Mexico.

When Colleen Hauser failed to appear for a court hearing Tuesday, Rodenberg issued an arrest warrant for her.

Rodenberg said it was in Daniel Hauser's best interests to receive conventional medical treatment.

He issued a contempt order for the mother and ordered the boy be placed in the custody of the Brown County Family Services agency.

Last January, Daniel Hauser's persistent cough, fatigue and swollen lymph nodes were diagnosed as Hodgkin's lymphoma.

In February, Hauser's cancer responded well to one round of chemotherapy.

Chemotherapy treatment side effects concerned the boy's parents, who decided to stop treatments and sought other medical opinions.

Doctors estimated Hauser's successful remission with further chemotherapy and possible radiation treatment at 80-95 percent, according to court documents.

The sheriff's office released several copies of a video produced by Asgaard Media that includes about two minutes of an interview with Colleen and Daniel Hauser.

The pair are sitting on a couch in an undisclosed location, and Colleen Hauser does most of the talking. She describes what she says are the side-effects of the chemotherapy on her son, saying ''he literally could not eat, he couldn't even drink.'' Colleen Hauser also says her son planned to run away from home by himself.

''Then what do I have? I mean, he was going to run,'' Hauser said. ''And that just broke my heart. I can't have one of my children running away from something that they should face.''

Hauser expresses optimism that her son can beat cancer, but nowhere in the video does she explain where they've been or what they've been doing since they left Sleepy Eye.

At one point, an unseen woman asks Daniel Hauser what he'd say to people who claim he's not old enough to decide whether he needs chemotherapy.

''I'd tell them to back off,'' Daniel Hauser said.

That the mother and her son were forced to come back and accept chemo shows that tragically, our country is throwing away its freedom. ---- The founding fathers who started this wonderful nation wanted freedom. A problem though can arise: "What if one of the freely successfuls MISUSES its power to destroy or boss others?" ---- This is what happened with modern medicine. It had apparent successes in relieving people of ailments; it thus had virtually unlimited growth, prestige, and power. However, it shrewdly used its prestige and power so that it would be viewed as THE only legitimate health care. It did this by defaming the natural healing professions calling them "quacks," "voodoo doctors," and "snake oil sellers." ---- The government swallowed this propaganda and gave modern medicine its iron arm. As with Daniel Hauser, may The Lord spare him, everyone WILL DO what the holy medical masters say!

The fact that the mother and her son tried to flee and were forced to come back and accept the chemotherapy exposes the fact that unfortunately, our country is very rapidly throwing away its freedom. ------------ Of course, please let me explain. ------------ The founding fathers and the other people who established this great and wonderful nation certainly were sincere in wanting to make a place where everybody would be truly and fully free. So now that everyone here is fully free to do his own thing, everyone began to freely do his own thing. Now some of the people were quite successful in their own things that they were freely doing and they thus became bigger and bigger. Now I am not against anyone at all for being successful and becoming even very big! Mr Hauser can't be faulted for not going on an appointment. There ARE several other children, and a dairy operation. If all the pieces did not fall into place to take care of those things of course he could not go.

Liberty Lady, with all due respect, I lost my mom two years ago to lymphoma, just like Daniel has. They wouldnt give her chemo in Mayo because it was too advanced. It was in the Bone marrow and lymph nodes. I feel passionately about Daniel. I don't want to see him die the same kind of death that I witnessed. We are all entitled to our opinion, that is why I am not living in Cuba. Isn't this a right to disagree in America. Disagreeing isn't a crime worthy of deportation. I only care about Daniel and I do have sympathy for the family. I just don't happen to agree with them and the county didn't have to let it get this far.

Shadow, Dr.Joyce said himself that it was the attorney who accompanied her and she was the one that hurriedly said "We have to go, we have other appointments to go to" Yes, I maybe am assuming but it doesn't take a scientist to figure it out. Why didn't Mr. Hauser attend the Doctors appt. with Colleen. My husband would have gone with me on something that critical. Why would you go with some so called attorney that probably paid about $20 to hang her shingle out just like the so called raindancing doctor. Also for your information, you are judging me and I will have you know that I for one buy tons of organic food and use all kinds of supplements. Im just mad that Brown county doesn't treat everyone the same, from personal experience. You are assuming I want her in Jail. NO I don't think it would help Daniel at all. Keep your assumptions to yourself

The reason they are not pressing charges and being so forgiving is because the court has been under alot of pressure from the media to back off now. The court is trying to cover their butts. So it is okay to run away from the law if you make it a big media event and get lots of people on your side. Only in America. No wonder we are on the verge of collaspe.We need a complete overhaul of the laws and business practices. Even the banks charge you now for taking in pennys for dollars.Let's pray that GOD comes down and gets rid of all the inmoral and greedy people and make everyone live in peace helping one another not trying to make a buck instead. What happened to us? Is money more important than helping your neighbor for anything but a "thanks alot for your help". People want to be paid for everything they do.

Cake lady you response that some attorneyu help her leave is out of left field . She left on her own every thing you mentioned was hearsay you have no idea who she left with or who she went to see . Your a typical type that thinks she know it all and really you dont know anything . I suppose you would like to see the mother go to jail .

Perhaps you should go eat your cake in some other country, like Cuba, China or North Korea. This Brown County judge and county attorney had no business dragging this devoted mother and her very ill son into court in the first place.

The whole darn family code "law" is subjective, whimsical, exempt from due process, exempt from Constitutional protection, etc. It is a criminal racket..children are cash for a lot of people.period!

Steven Baskerville, author of Taken Into Custody said recently, ...the numbers are in and fully 17 million minor children now live in America under the custodial control of family courts! One-fourth of all minor children.and rising!

I only wish Brown County would be so lenient with everyone who skips their court case. Since when do they coddle someone who flees with a critically ill child, just like enticing a dog with a bone. I have nothing but concern for Daniel and only hope that he recovers. Im sick of people making up their own rules. A law is a law for all of the people. We can't pick and choose wheather or not we don't like a judges ruling so we are going to run. She said herself that if the xray showed a change in the tumor, they would go ahead with the chemo but blatantly did the opposite. Now she said that daniel was going to run away, but she herself had the gig all prepared for with plane tickets, leaving a cell phone and running out of Dr. Joyce's office despite the fact that Daniel told Dr.Joyce that his chest pain was a 10 on a scale of 1-10. Real common sense?? Maybe she needs to participate in the cognitive classes that others are sentenced to. Making better choices in her life!

This was all a plot to get national media coverage to gain support for the Hauser crusade. There will be a movie and a book made of this for personal gain. Only in America the land of the rich and greedy and immoral personal gain can this happen. If the father had taken off with the kid would Colleen have taken him to court and would the court now be so friendly and forgiving.

Just a question: what is the number of the Minnesota statute relevant to the court ruling? Does the wording of it say something very specific like "an obligation is imposed to provide the BEST medical care available, as indicated by board-certified physicians in the state of Minnesota"? Or is it more general, simply indicating that there is an obligation to "try something"?

I wonder if the attorney that helped them flee even has a valid lawyer license? Just like the so called "medicine Man"who thinks he can practice medicine without a license too. To say the least, any credible attorney doesnt help a client flee from a court appearance. Maybe she should have to help pay for all of the costs this ridiculous folly has cost Brown County.

No matter which side of the fence you are on, I think the Hauser's attorney SHOULD see some sort of charges. When you know the legal system, you don't skip town with your client. She should have her license to practice law revoked.
