Members present: Seeboth, Berg, Dove, Lochner, and Potter along with County Administrator Enter and County Attorney Olson.

On Tuesday, 1-6-09, at 8:15 AM in the Commissioners Room 204 of the Brown County Courthouse located in New Ulm, MN, Fifth Judicial District Judge John Rodenberg administered the oath of office to County Commissioners Richard Seeboth of District 1 and Deborah Dove of District 3, County of Brown, State of Minnesota.

At 8:45 AM, the Board of Brown County Commissioners met for the purpose of organizing the County Board for 2009 through the election of Chair and Vice-Chair.

Upon nomination by Berg, M/Lochner, S/Dove to cease nominations and cast a unanimous ballot for Commissioner Seeboth as Board Chair of the Brown County Board of Commissioners for 2009, carried.

Upon nomination by Potter and seconded by Seeboth, M/Lochner, S/Dove, to cease nominations and cast a unanimous ballot for Commissioner Berg as Board Vice-Chair of the

Brown County Board of Commissioners for 2009, carried.

M/Lochner, S/Seeboth, to adopt Robert's Rules of Order with the three (3) additional stipulations listed, carried, with Berg dissenting.

At 9:00 AM, M/Potter, S/Berg, to accept the Minutes of 12-23-08 and authorize publication of the Synopsis of same, carried.

M/Berg, S/Lochner, to schedule a Closed Session for labor negotiation strategy planning to be held in the Commissioners Room 204 of the Brown County Courthouse, New Ulm, MN at approximately 9:30 AM this date 1-6-09 for the Law Enforcement Labor Services, Inc. (LELS) Locals #94 and #98 and for the two (2) AFSCME Collective Bargaining Units (Courthouse and Highway) pursuant to MS 13D.03, carried.

M/Lochner, S/Potter, to authorize the payment of final 2008 General Government claims in the amount of $170,286.33, carried.

M/Berg, S/Lochner, to authorize the payment of 2009 General Government claims in the amount of $79,413.70, carried.

M/Dove, S/Potter, to resolve to approve the Off-Site Gambling Application of the Leavenworth Baseball Association for the event scheduled for 2-14-09, carried.

M/Lochner, S/Potter, to approve payment for the Brown County Ag Society Promissory Note dated 2-5-08 regarding the $6,000 loan balance due from the Ag Society for the Fairgrounds Bus Garage/Exhibit Building as the final payment through application of $6,000 of Brown County Ag Society 2009 appropriation (budget line item: 01-600.6804) as reimbursement to the Capital Improvement Fund with said payment to fully retire the original $60,000 loan authorized on 5-18-99, carried.

M/Berg, S/Lochner, to accept and file the report on MRCI matters as provided by Charles Guggisberg, the County Board's Representative to MRCI, carried.

M/Berg, S/Potter, to appoint a committee consisting of Commissioners Seeboth and Lochner along with the county administrator to recommend budget balancing measures necessary with respect to state and federal funding reductions to date along with pending state aid reductions and as relates to state mandated services and levy limitations, carried.

M/Lochner, S/Berg, to appoint Commissioner Dove as representative and Commissioner Seeboth as alternate to serve as County Board representatives to the Brown County Drug Court Committee(s), carried.

M/Berg, S/Dove, to appoint Commissioner Seeboth as representative and Commissioner Potter as alternate to serve as County Board representatives to the Highway 14 Partnership, carried.

M/Potter, S/Berg, to approve the appointment of Terese Gruber as the Office Support Specialist for the Probation Dept. at the annual rate of $25,493.00 (Grade VI, Step 4) contingent on passage of the pre-placement physical and background check and with a projected start date of 1-19-09, carried.

At 9:33 AM, Chairman Seeboth convened a Closed Session for Labor Negotiation Strategy Planning, pursuant to M.S.13D.03, for the LELS, Inc. Locals #94 and #98 Sheriff's Department Collective Bargaining Units; and for the two (2) AFSCME Collective Bargaining Units (Courthouse and Highway). This session was attended by Commissioners Seeboth, Berg, Dove, Lochner, and Potter, along with County Administrator Enter, County Attorney Olson, Sheriff Hoffmann, Highway Engineer Stevens, Personnel Director Crabtree, and Attorney Frank Madden via telephone at 9:34 AM. The Closed Session adjourned at 9:50 AM.

Correspondence C-1 thru C-8 were accepted and filed.

Berg reported on the Enterprise North meeting of 1-5-09 and on the Extension meeting

of 1-5-09; Dove reported on the RC&D meeting of 1-5-09.

Calendars were coordinated for the next two week period.

At 10:02 AM, Chairman Seeboth convened a Public Hearing on proposed revisions to

Brown County Fee Schedule pursuant to MN Statute 373.41. There being no public testimony, M/Potter, S/ Dove, to close the public hearing and to adopt the following fee schedule revisions effective this date 1-6-09: PARKS: Camping Tent Area - $10.00/unit; Camper/RV Area (electric sites) - $20.00/unit. PLANNING & ZONING: New dwellings & New non-ag accessory structures - $0.05/sq.foot with $26.25 min.; Addition to dwellings and non-ag accessory structures, incl. decks & porches - $0.05/sq.foot with $26.25 min.; Exterior alterations to dwellings, ag, non-ag, commercial structures - No change to building footprint ex.: shingling, windows, siding, enclose porch - $15.00; Agriculture structures - $0.02/sq.foot with $26.25 min. & $500 max.; Commercial/business structures and additions permits -
