SYNOPSIS OF COUNTY BOARD MEETING

November 4, 2008

Members present: Seeboth, Berg, Guggisberg,

Lochner and Potter, along with County

Administrator Enter and Assistant County Attorney

Hinnenthal.

M/Seeboth, S/Potter, to accept the Minutes of

10-28-08 and authorize publication of the

Synopsis of same, carried.

M/Guggisberg, S/Berg, to schedule a Closed

Session for labor negotiation strategy planning to

be held in the Commissioners Room 204 of the

Brown County Courthouse, New Ulm, MN at

approximately 11:00 AM this date 11-4-08 for the

Law Enforcement Labor Services, Inc. (LELS)

Locals #94 and #98 and for the two (2) AFSCME

Collective Bargaining Units (Courthouse and

Highway) pursuant to MS 13D.03, carried.

M/Berg, S/Potter, to authorize the payment of

General Government claims as amended in the

amount of $52,685.14, carried.

M/Berg, S/Potter, to authorize the five (5)

Drainage Ditch Repair requests, carried.

M/Potter, S/Seeboth, to accept and file the

update on the Manatron project, carried.

M/Guggisberg, S/Berg, to accept and file the

STS Quarterly Report for the 3rd Quarter of 2008,

noting an estimated market value of the labor on

completed projects in the amount of $27,555; fines

worked off in the amount of $9,384; and a total of

1,800 hours worked this quarter by offenders,

carried.

M/Seeboth, S/Berg, to approve the Brown

County Evaluation Center, Inc. Detention Division

Host County 2009 Purchase of Service

Agreement for detention services and authorize

the County Board Chair, County Attorney and

Probation Director to sign same on behalf of

Brown County, carried.

Correspondence C-1 thru C-5 was accepted

and filed.

Guggisberg reported on Three Rivers RC&D

and on the MRCI meeting on 11-3-08; and

Seeboth reported on the Park Commission

meeting on 11-3-08.

M/Guggisberg, S/Berg, to accept and file the

informational reports on 2009 ag values, Law

Changes 2a, 2b, and Green Acres changes as

presented by County Assessor Friesen, carried.

M/Berg, S/Guggisberg, to approve the

Conditional Use Permit App. #C-00209 by Pam

Kriauciunas for Morgan Wind Acquisition Group,

LLC on property described as the West 73 acres

of the NW4 Sec. 19-T111N-R33W, Eden

Township, Brown County, for the purpose of

allowing use of a 60 meter, approx. 198',

meteorological tower for data gathering for a

proposed wind generation project for a three year

period of time, carried.

M/Guggisberg, S/Berg, to advance the

proposed fee changes in the Planning and Zoning

Dept. including an approximate 5% increase to

general P&Z fees (that have been unchanged for

three to five years) and the proposed Wetland

Conservation Act (WCA) fees to the pending fees

public hearing and final consideration, carried.

M/Berg, S/Seeboth, to approve the Agreement

for Services between Brown County and Brown

County Soil & Water Conservation District for the

purpose of facilitating the administration of the

Wetlands Conservation Act (WCA); and to

approve the State of Minnesota Board of Water

and Soil Resources 2009 Natural Resources

Block Grant for the period of 7-1-08 through 6-30-

10 in the amount of $86,823, carried.

M/Guggisberg, S/Seeboth, to authorize the

purchase of a UmMac UX35PV 35 lb capacity

commercial grade washing machine from BDS

Laundry Systems in the amount of $8,617, plus

sales tax, with funding provided by the Jail

Commissions account, carried. An additional

quote was received from R.J. Kool Co.

M/Potter, S/Guggisberg, to authorize the

purchase of a 2008 Ford Police Interceptor squad

(street appearance) with options specific to Brown

County from Administration Minnesota "MinnBid"

for up to $17,120, carried. It should be noted this

vehicle is a lease return from the MN DOC back to

Administration Minnesota with 7,959 miles and

with the standard state contract features plus

some additional options.

M/Berg, S/Potter, to approve regular employee

status for Jane Schmid, FT Probation Agent,

carried.

M/Guggisberg, S/Potter, to accept the

resignation of Jamie Rodriguz, FT Financial

Worker/Spanish, effective 10-30-08 and authorize

posting the position vacancy internal/external

simultaneously, carried.

M/Seeboth, S/Potter, to accept the resignation

of Margery Oehlke, Regular PT HHA/Homemaker

effective 10-1-08, carried.

M/Guggisberg, S/Berg, to appoint Angela

Gauert to the FT Assessment Technician position

at the annual salary of $28,469 (Grade VIII, Step

2) with a projected start date of 11-20-08 and to

authorize to post the vacated position according to

contract/policy, carried.

Calendars were coordinated for the next two

week period.

At 11:05 AM, Chairman Lochner convened a

Closed Session for Labor Negotiation Strategy

Planning, pursuant to M.S.13D.03, for the LELS

Locals #94 and #98 Sheriff's Department

Collective Bargaining Units; and for the two (2)

AFSCME Collective Bargaining Units (Courthouse

and Highway). This session was attended by

Commissioners Seeboth, Berg, Guggisberg,

Lochner and Potter, along with County

Administrator Enter, Assistant County Attorney

Hinnenthal, Sheriff Hoffmann, Highway Engineer

Stevens, Personnel Director Crabtree and

Attorney Frank Madden via telephone at 11:06

AM. The Closed Session adjourned at 11:35 AM.

There being no further business, Chairman

Lochner declared the Meeting adjourned at 11:35

AM.
