Brody W. Conklin, 27, 55503 286th St., Gibbon, was charged Monday with felony fifth-degree possession-not small amount of marijuana.

According to a Statement of Probable Cause, at 5:43 p.m., March 25, 2016, a New Ulm Police talked with a Brown County Probation Agent over the phone about seeing Conklin driving on in New Ulm. He was under house arrest as part of his release conditions.

The agent asked police to stop Conklin if he left the residence and ask why he was not at the residence. Police saw Conklin drive away from the residence and stopped him. Conklin said he forgot to notify his agent before going out in public. The agent told police they would issue an apprehension and detention order for the violation. Conklin was arrested for the violation.

Searching Conklin, police found a zip lock sandwich baggie that was rolled up with a white, powdery substance on the floor by the driver’s seat of the vehicle with a small bulge on one end and three unidentified pills in the baggie.

Police later identified the pills as buprenorphone hydrochloride and naloxone hydrochloride, a schedule III controlled substance, which require a prescription and are a combination narcotic.

Joshua A. Lang, 35, 510 1st Ave. North, Sleepy Eye, was convicted Monday of felony threats of violence. Sentence is a stay of imposition, successful probation completion will result in a misdemeanor conviction. Charges of fifth-degree assault and disorderly conduct were dismissed.

He was fined $1,160 and sentenced to 30 days in the Brown County Jail, credited for serving 13 days, may serve remaining jail days via STS if all applicable fees paid, to be done within 18 months of sentencing. Credit to fine for out-of-pocket mental health assessment and recommendation costs. Conditions include completion of chemical use assessment and diagnostic assessment, follow recommendations, no contact with victims.

Michael Nicholas L. Tackett, 22, 100 S. Broadway, was convicted Monday of felony fleeing a peace officer. Sentence is a stay of imposition. Successful probation completion will result in a misdemeanor conviction. Charges of theft, fleeing a peace officer and tampering with a motor vehicle without owner permission were dismissed. He was fined $875, sentenced to 41 days in the Brown County Jail and placed on three years supervised probation. Conditions include paying restitution before fines, fees and surcharges, restitution open for 30 days, complete chemical use assessment and mental health evaluation, follow recommendations; do not use or possess firearms, ammunition or explosives, 3 days STS on schedule with probation.

Michael J. Alexander, 40, Rochester, was convicted Monday of felony receiving stolen property. Sentence is a stay if imposition, successful probation completion will result in a misdemeanor conviction. Charges of theft and drug possession over 1.4 grams marijuana in a motor vehicle were dismissed.

He was fined $1,583.76 including $423.76 restitution, and sentenced to 95 days in the Brown County Jail. He was placed on five years supervised probation. Conditions include paying restitution, open for 30 days, before fines, fees, surcharges; complete chemical use assessment, mental health evaluation, follow all recommendations, do not use or possess firearms, ammunition or explosives, do not enter any Walmart store.
