NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN, that the City Council of the City of New Ulm, Brown County, Minnesota will meet in the Council Chambers in the New Ulm City Hall on Tuesday, August 7, 2018 at 4:30 p.m. to consider ordering in the following improvements, except items 6, 7, 8, and 9 which have previously been approved to be made, to-wit:

2018 Utility, Street and Alley Improvements – Group I

1. Cottonwood Street from Butternut Street to 250 feet south of Ridgeview Drive – Grading, aggregate base, bituminous base, storm sewer, pavement edge drains, concrete curb and gutter, concrete sidewalk, concrete driveway pavement, bituminous surfacing, recreational trail, boulevard trees, boulevard restoration, street lighting and property acquisition.

2. Ridgeview Drive from Cottonwood Street to west terminus – Grading, aggregate base, bituminous base, pavement edge drains, concrete curb and gutter, concrete sidewalk, concrete driveway pavement, bituminous surfacing, boulevard trees, boulevard restoration, street lighting and property acquisition.

3. Jefferson Street from 5th to 7th North Street – Reconstruction of the existing water main, sanitary sewer main, sewer and water end services, and reconstruction of the existing roadway section including excavation and replacement of subgrade, aggregate base, bituminous paving, storm sewer extension, concrete curb and gutter, concrete driveway pavement, pedestrian sidewalk ramps, street lighting and selective replacement of concrete sidewalk.

4. Alison Avenue, Ryan Road, Airport Road, Maplewood Drive and the alley in and adjacent to Sarah Hills Third Addition – Grading, aggregate base, bituminous base, concrete curb and gutter, concrete sidewalk, concrete driveway pavement, bituminous surfacing, boulevard trees, boulevard restoration and street lighting.

5. Oakwood Avenue from North Highland Avenue to Hazelwood Avenue – Reconstruction of the existing roadway section including excavation and replacement of subgrade, pavement edge drains, aggregate base, bituminous paving and selective replacement of concrete curb and gutter and concrete driveway pavement.

6. Alley Block 185 North of Center Street – Grading, aggregate base, bituminous surfacing, seven inch (7″) concrete alley approach pavement, storm sewer, miscellaneous removals and restoration necessary to construct a residential alley pavement section (improvement petitioned).

7. Alley Block 152 North of Center Street – Grading, aggregate base, bituminous surfacing, seven inch (7″) concrete alley approach pavement, storm sewer, miscellaneous removals and restoration necessary to construct a residential alley pavement section (improvement petitioned).

8. Alley Block 10 South of Center Street – Grading, aggregate base, bituminous surfacing, seven inch (7″) concrete alley approach pavement, miscellaneous removals and restoration necessary to construct a residential alley pavement section (improvement petitioned).

9. Alley Block 143 South of Center Street – Grading, aggregate base, bituminous surfacing, seven inch (7″) concrete alley approach pavement, storm sewer, miscellaneous removals and restoration necessary to construct a residential alley pavement section (improvement petitioned).

10. 20th North Street from Spring Street to alley in Block 202 North and Front Street from 20th North Street to 19th North Street – Water main, sanitary sewer main, sanitary sewer lift station and force main, sanitary sewer and water end services, storm sewer modification, roadway and boulevard restoration.

11. Birchwood Drive, Turner Road and Maplewood Drive in Fairhills Fifth Addition – Construct bituminous wear course and pedestrian sidewalk infill.

12. Miscellaneous Concrete Sidewalk Repairs – Settlement on Summit Avenue

pursuant to Minnesota Statutes, Sections 429.011 to 429.111. The area proposed to be assessed for such improvements is each lot, piece and parcel of property specially benefited by said improvements. A reasonable estimate of the impact of the assessment will be available at the hearing. The total estimated cost of the 2018 Utility, Street and Alley Improvements – Group I project is $3,470,093.50. Such persons as desired to be heard with reference to the proposed improvements will be heard at this meeting.

2018 MSAS Improvement Project

1. German Street from 3rd North Street to 7th North Street– Reconstruction of the existing water mains, sanitary sewer main, sewer and water end services, and reconstruction of the existing roadway section including excavation and replacement of subgrade, aggregate base, bituminous paving, concrete curb and gutter, concrete driveway pavement, pedestrian sidewalk ramps, pedestrian crosswalk extensions at 4th and 5th North Street, street lighting and selective replacement of concrete sidewalk.

pursuant to Minnesota Statutes, Sections 429.011 to 429.111. The area proposed to be assessed for such improvements is each lot, piece and parcel of property specially benefited by said improvements. A reasonable estimate of the impact of the assessment will be available at the hearing. The total estimated cost of the 2018 MSAS Improvements Project is $1,342,924.00. Such persons as desired to be heard with reference to the proposed improvements will be heard at this meeting.

In Re: Palmer Family Irrevocable Life Insurance Trust Agreement

ORDER FOR HEARING ON THE PETITION TO MERGE TRUSTS

It is Ordered and Notice is given that on August 24th, 2018, at 2:00 p.m., a hearing will be held in this Court at the Brown County Courthouse, 14 S. State Street, New Ulm, Minnesota, for the consideration of the Petition to merge the Palmer Family Irrevocable Life Insurance Trust and the Palmer Family Irrevocable Insurance Trust.

Notice of the hearing shall be given in accordance with Minn. Stat. 501C.0203 as follows: by publishing as at least 20 days before the date of the hearing, a copy of the order for hearing one time in a legal newspaper for the county in which the petition is filed; and by mailing, at least 15 days before the date of the hearing, a copy of the order for hearing to those qualified beneficiaries of the trust who are known to or reasonably ascertainable by the petitioner.

Any objections to the petition must be filed with the Court prior to or raised at the hearing.
