• Jacob O. Dietz, 30, 14620 215th St., New Ulm, was charged with two counts of gross misdemeanor 3rd-degree DWI, misdemeanor open bottle, possession of marijuana in motor vehicle, possession of marijuana Friday.

According to court documents, New Ulm Police were informed Oct. 5 that a vehicle belonging to Dietz was parked at 6 S. Minnesota St. Dietz has an active warrant out for him. At about 1:20 a.m., police observed a suspect vehicle southbound past 1st South Street in Minnesota Street, traveling 40 mph in a 35 mph zone.

Police stopped the the vehicle, confirmed the driver was Dietz and detected a marijuana odor coming from the vehicle and a moderate odor of an alcoholic beverage coming from Dietz. He showed intoxication clues and admitted drinking and smoking marijuana days earlier. Police found an opened beer can in the vehicle and a green, leafy substance confirmed to be marijuana in the driver’s seat and in the rear passenger area.

The marijuana weighed 2.1 grams total. Passengers in the vehicle denied the marijuana belonged to them. Dietz failed a Preliminary Breath Test and was arrested for DUI. A breath sample for analysis showed an alcohol concentration of .15 grams per 210 liters of breath. Dietz’ driving record showed a qualified prior impaired driving incident on Oct. 26, 2010.
